These Terms of Service ("Terms") are a legal agreement between Only Bundles, based in Delhi, India ("Only Bundles," "we," "us," or "our"), and the person or business that installs, accesses, or uses the Services ("Merchant," "you," or "your").
1. Agreement and authority
By installing or using Only Bundles, you agree to these Terms and our Privacy Policy. If you act for a business, you confirm that you have authority to bind it. You must be legally capable of entering a contract and maintain a valid Shopify merchant account. If you do not agree, do not install or use the Services.
2. The Services
Only Bundles lets merchants configure and display Shopify bundle experiences, including full-page and product-page bundle builders, storefront design settings, bundle pricing or discount configurations, and related reporting or attribution features made available in the application. The public website and demo are informational and non-transactional.
Only Bundles is an independent application. Shopify is not a party to these Terms, and Shopify's own terms, policies, APIs, platform limits, billing systems, checkout, themes, and services also govern your store.
3. Licence and access
While these Terms remain in effect, we grant you a limited, revocable, non-exclusive, non-transferable right to access and use the Services for your Shopify business in accordance with the applicable plan, documentation, and these Terms. You may permit authorized staff and contractors to use the Services on your behalf, and you are responsible for their actions.
4. Merchant responsibilities
You are responsible for:
- your Shopify account, credentials, staff permissions, products, catalogue, prices, inventory, taxes, shipping, fulfilment, customer service, refunds, and legal compliance;
- testing and accurately configuring each bundle, discount, selling plan, gift, add-on, custom selector, script, text, design setting, and theme placement before publishing it;
- ensuring product descriptions, savings statements, prices, availability, and other claims shown to shoppers are truthful and current;
- providing legally required privacy notices and obtaining any consent or other lawful basis for storefront data, pixels, marketing parameters, or customer information you instruct us to process;
- checking theme and third-party app compatibility, cart and checkout outcomes, and the effect of Shopify platform changes; and
- promptly removing access from unauthorized users and notifying us of suspected compromise.
5. Acceptable use
You must not misuse the Services. In particular, you must not:
- violate law, consumer rights, intellectual-property rights, privacy rights, Shopify policies, or another person's rights;
- upload malicious code, disrupt or probe the Services, bypass access controls or plan limits, or access another merchant's data;
- reverse engineer, copy, resell, sublicense, or create a competing service from protected parts of Only Bundles except where law expressly permits;
- use the Services for fraud, deceptive offers, unlawful discrimination, spam, or harmful products; or
- misrepresent an affiliation with Only Bundles or Shopify.
6. Plans, billing, and taxes
Available free and paid plans, included features, trial terms, and current prices are displayed in the Shopify App Store or the application's billing screen. Shopify processes app subscriptions and charges. By approving a paid plan, you authorize Shopify to bill the applicable recurring and usage-based charges, if any, under Shopify's billing terms.
Unless law requires otherwise, charges already incurred are non-refundable. You are responsible for applicable taxes other than taxes on our net income. Cancelling, downgrading, or uninstalling may change access to paid functionality as described at the time of the change.
7. Merchant data and content
As between you and Only Bundles, you retain rights in the data, text, scripts, images, configuration, and other content you submit or direct us to process ("Merchant Content"). You grant us a limited licence to host, copy, transform, transmit, and display Merchant Content only as needed to provide, secure, support, and improve the Services and meet legal obligations.
You confirm that you have all rights and permissions needed for Merchant Content and our processing of it. Our handling of personal information is described in the Privacy Policy. When we process shopper data for you, you are generally the controller or business and we act as your processor or service provider, subject to applicable law.
8. Service operation and changes
We aim to provide a dependable service but do not promise uninterrupted or error-free operation. Shopify, themes, browsers, networks, products, third-party apps, and merchant configurations can affect results. We may maintain, modify, add, or discontinue functionality to improve security, comply with law or Shopify requirements, or evolve the Services. We will provide reasonable notice of a material adverse change where practicable.
Previews and demonstrations use non-transactional example data and do not guarantee compatibility, revenue, conversion, average order value, discounts, inventory outcomes, or shopper behaviour on your store.
9. Third-party services
The Services depend on Shopify and may interoperate with merchant-selected themes, apps, selling plans, analytics tools, and other third-party services. Their terms and privacy practices apply separately. We are not responsible for third-party services, changes, outages, data, or conduct outside our reasonable control.
10. Intellectual property and ownership
Only Bundles and its licensors retain all rights in the Services, software, designs, documentation, trademarks, and related technology, excluding Merchant Content and third-party materials. No rights are granted except those expressly stated in these Terms. If you provide feedback, you permit us to use it without restriction or payment, provided we do not identify you publicly without permission.
11. Confidentiality
Each party will use the other party's non-public information only to perform under these Terms and will protect it with reasonable care. This duty does not cover information that is public without breach, already lawfully known, independently developed, or lawfully received from another source. A party may disclose information when legally required after giving notice where permitted.
12. Suspension and termination
You may stop using the Services or uninstall the application at any time. We may suspend or terminate access if you materially breach these Terms, fail to pay approved charges, create a security or legal risk, violate Shopify requirements, or if Shopify prevents us from providing the Services. Where reasonable, we will give notice and an opportunity to cure.
On termination, your licence ends and you must stop using the Services. Provisions that by their nature should survive—including payment obligations, ownership, disclaimers, liability limits, indemnity, and dispute terms—will survive. Data is handled under the Privacy Policy and applicable Shopify privacy workflows.
13. Disclaimers
To the maximum extent permitted by law, the Services are provided "as is" and "as available." We disclaim implied warranties of merchantability, satisfactory quality, fitness for a particular purpose, non-infringement, and warranties arising from course of dealing. We do not warrant that a bundle configuration will be compatible with every theme or app, remain unaffected by Shopify changes, or produce any commercial result. Nothing in these Terms excludes a warranty or consumer right that cannot legally be excluded.
14. Limitation of liability
To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, exemplary, punitive, or consequential damages, or for lost profits, revenue, goodwill, data, business opportunity, or business interruption, even if advised of the possibility.
To the maximum extent permitted by law, Only Bundles' total aggregate liability arising from the Services or these Terms will not exceed the greater of (a) the fees you paid for Only Bundles during the 12 months before the event giving rise to liability, or (b) INR 10,000.
These exclusions and limits do not apply to fraud, wilful misconduct, breach of confidentiality, infringement or misappropriation of intellectual-property rights, indemnity obligations, payment obligations, or any liability that law does not allow to be limited.
15. Indemnity
To the extent permitted by law, you will defend and indemnify Only Bundles and its personnel against third-party claims, losses, and reasonable costs arising from your Merchant Content, products, offers, storefront, violation of law or Shopify requirements, or material breach of these Terms. We will promptly notify you and allow you to control the defence, provided no settlement admits our fault or imposes obligations on us without consent.
16. Governing law and disputes
These Terms are governed by the laws of India, without regard to conflict-of-law rules. Subject to any mandatory law that gives you another forum or right, the courts located in Delhi, India have exclusive jurisdiction. Before filing a claim, each party will attempt in good faith for at least 30 days to resolve the dispute after written notice.
17. General terms
These Terms and the Privacy Policy are the entire agreement about the Services and replace prior discussions about that subject. If a provision is unenforceable, it will be modified only to the minimum extent necessary and the remainder will continue. A failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them as part of a reorganization, financing, merger, acquisition, or sale. Neither party is liable for delay caused by events beyond reasonable control. Headings are for convenience only.
18. Changes and contact
We may update these Terms by posting a revised version and changing the date above. If a change materially affects your rights, we will provide additional notice where required. Continuing to use the Services after the effective date of revised Terms constitutes acceptance to the extent permitted by law.
